Whistleblower
The Scharfman Law Firm, PLLC represents clients in whistleblower claims all over Texas, and is an aggressive advocate for our clients and their rights. We are committed to helping employees fight for their rights when they have suffered from unlawful retaliation for being a whistleblower.
Texas law protects whistleblowers in public sector and select private sector jobs.
Some examples are referenced below:
Under the Texas Government Code, it is unlawful for a governmental employer to discriminate against and/or discharge an employee on the basis of that employee’s good faith report of a violation of the law.
Under the Texas Health and Safety Code, it is unlawful for certain health care institutions, including hospitals, to discriminate against and/or discharge an employee on the basis of that employee having reported a violation of law or other listed violations to a particular person within management/administration of the institution.
Similarly, the Texas Health and Safety also makes it unlawful for a nursing home to discriminate against and/or discharge an employee on the basis of that employee having reported a violation of law or other listed violations to a particular person within management/administration of the nursing home.
There is also a federal law called the False Claims Act, which contains qui tam provisions providing for individuals to be able to assist the federal government in fighting fraud. For example, an individual can use these provisions to potentially obtain recovery for bringing to light a corporation that is defrauding the federal government from revenues that are owed to the government.
Certain filing deadlines and statutes of limitations apply to these claims.
